  On April 26, The Paper learned from the official website of the Chongqing Municipal Bureau of Land and Housing Resources that the Chongqing Municipal Bureau of Land and Housing Resources, the Chongqing Municipal Finance Bureau, the Chongqing Municipal Commission of Urban and Rural Construction, and the Chongqing Branch of the People's Bank of China recently jointly issued the "Implementation Opinions on Matters Concerning the Protection of the Rights and Interests of Housing Provident Fund Contributors in Housing Loans".

  Nine measures have been proposed, including shortening the loan approval time limit, strictly assessing the entrusted loan business, and strengthening the management of sales behaviors, to safeguard the legitimate rights and interests of housing provident fund contributors, effectively leverage the role of the housing provident fund system, and regulate the order of the real estate market.

  At the same time, housing development enterprises are required to sign a "Commitment Letter on Supporting Home Buyers in Using Housing Provident Fund Loans" with home buyers.

  The Chongqing Housing Provident Fund Management Center and the entrusted banks have been required to standardize the business process of provident fund loans, reduce approval steps and shorten the approval time limit.

  Specifically, shorten the time limit for loan approval. The municipal housing provident fund management center and the entrusted banks should standardize the business process of provident fund loans, reduce approval steps and shorten the approval time limit. If the loan is approved and the materials are complete, the approval should be completed within 10 working days. After approval, the housing provident fund loan will be issued within 5 working days after the mortgage registration is completed. Where a loan is not approved, the reasons shall be stated. If the materials are incomplete, the materials that need to be supplemented and improved should be informed at one time.

  Strictly assess the entrusted loan business. The entrusted bank should support the combined housing provident fund loan. When arranging the commercial loan quota, it should actively meet the demand for the combined housing provident fund loan and issue it in a timely manner. The housing provident fund management center should strengthen the assessment of entrusted banks and improve the assessment methods. Where the allocation of combined loan quotas is inappropriate, affecting the issuance of combined loans, or where the use of housing provident fund loans by home-buying employees is restricted, obstructed or refused, or where the issuance of housing provident fund loans is delayed, the loan handling fee shall be deducted. In serious cases, the qualification for handling housing provident fund entrusted business (including collection business and loan business) shall be suspended or cancelled.

  Strengthen the management of sales behavior. The departments of land and housing administration and urban and rural construction should strengthen the supervision of the real estate market. Real estate development enterprises should promptly apply to the housing provident fund management center for the filing of housing provident fund loans. When selling commercial housing, real estate development enterprises and housing sales intermediary agencies must publicly disclose the housing sources at one time. They shall not refuse home buyers from using housing provident fund loans to purchase houses on the grounds that they have not applied for filing with the housing provident fund management center, nor shall they add any form of restrictive conditions or additional conditions to obstruct or refuse home buyers from using housing provident fund loans to purchase houses. No differential treatment shall be given to home buyers who have taken out housing provident fund loans in terms of house selection or house sales prices. Real estate development enterprises and housing sales intermediary agencies must publicly display the above-mentioned contents in the form of written commitments at the sales site of the properties.

  Improve the efficiency of mortgage registration. All levels of real estate registration authorities shall strictly follow relevant regulations, promptly accept applications for mortgage registration of housing provident fund loans, improve the efficiency of mortgage registration of provident fund loans, and ensure that the mortgage registration procedures are completed within 7 working days from the date of acceptance.

  Make the business processing procedures public. All levels of housing provident fund management centers should disclose the business process, approval requirements, processing locations, processing departments and completion time limits of housing provident fund loans through TV, newspapers, radio, the Internet and other news media, and set up publicity boards and bulletin boards in prominent positions at business processing outlets to clearly indicate them.

  Establish information sharing among departments. The municipal land and housing administration department, the municipal urban and rural construction department, and the Chongqing Branch of the People's Bank of China have established an information sharing mechanism for handling housing provident fund loan business in accordance with the requirements of The State Council's "Internet + Government Services", to enhance the efficiency and service level of handling housing provident fund loan business.

  Strengthen the intensity of joint disciplinary actions. All levels of land and housing management departments, urban and rural construction departments, the Chongqing Branch of the People's Bank of China, and the housing provident fund management center should establish a joint investigation and handling mechanism. For real estate development enterprises and housing sales intermediary agencies that are verified to have restricted, obstructed or refused home buyers' use of housing provident fund loans to purchase houses, the housing provident fund management center shall order them to rectify within a time limit. For development enterprises and housing sales intermediary agencies with serious violations, refusal to rectify, failure to implement rectification, and repeated violations, they should be publicly exposed. The Housing Provident Fund Management Center should submit a written suggestion to the land and housing administration department to suspend the pre-sale permit of the project, suspend online signing, and submit a written suggestion to the urban and rural construction department to suspend the disbursement of pre-sale supervision funds. For those with particularly serious violations, the Housing Provident Fund Management Center shall submit a written suggestion to the Chongqing Branch of the People's Bank of China and record it in the enterprise credit information system.

  Smooth the channels for complaints and reports. If real estate development enterprises and housing sales agencies obstruct or refuse home buyers' use of housing provident fund loans, complaints and reports can be made through the 12329 Housing Provident Fund Management Center hotline or the 12345 Citizen hotline. Based on the clues of complaints and reports, the land and housing management departments, urban and rural construction departments, and housing provident fund management centers at all levels should respond promptly and handle the cases in a timely manner.
